Martinez accused Berry of physically attacking their 12-year-old son, while Berry’s attorney called the claims “entirely meritless and deliberately misleading.”

Halle Berry and Olivier Martinez are facing another major legal dispute over their 12-year-old son, Maceo, after Martinez accused Berry of physically attacking the boy and secured a temporary restraining order against her.

Martinez alleged in court documents that Berry choked Maceo during a Sept. 26 confrontation at her home. He claimed the dispute began after Berry became upset with their son while he was playing a virtual reality game. Martinez also alleged that the incident was part of a broader pattern of physical and verbal conflict.

The allegations have not been proven in court. Berry has strongly disputed Martinez’s account through her attorney, Marina Beck, who called the filing “entirely meritless and deliberately misleading.”

TMZ, which first reported Martinez’s filing and later obtained Berry’s response, reported that Berry also accused Martinez of repeatedly violating court orders and interfering with therapeutic and educational interventions involving Maceo. She further pointed to what she described as his history of “erratic, possessive and violent behavior.”

That reference appears to include a 2012 confrontation between Martinez and Gabriel Aubry, Berry’s former partner and the father of her daughter Nahla. Aubry accused Martinez of attacking him during a Thanksgiving Day altercation connected to a custody dispute.

Martinez’s side disputed Aubry’s version at the time and maintained that Aubry was the aggressor.

A Los Angeles County judge granted Martinez a temporary restraining order on Oct. 1. Berry must stay 100 yards away from Martinez, while her contact with Maceo is temporarily limited to court-ordered visitation. The judge did not completely bar Berry from seeing her son, and a request for sobriety monitoring was reportedly denied because the court found insufficient evidence for that condition.

The court has also ordered Berry and Martinez into confidential mediation over custody. Martinez is seeking sole custody, while Berry continues to challenge his allegations.

The temporary order does not determine whether the abuse claims are true. The next significant court date is Oct. 16, when the custody arrangements and restrictions can be reviewed as the dispute continues.
