Tiffany Haddish just scored a small win in court, as her DUI case drags on.

A Fayette County Court judge ruled on Wednesday. The state cannot use one field sobriety test or Haddish’s statements to police at trial.

The officer administered the Horizontal Gaze Nystagmus (HGN) test incorrectly. Haddish told the officer she has a lazy eye. He did not ask follow-up questions. He also did not consider how a lazy eye might affect the results. The judge found the test unreliable.

The judge also ruled that officers failed to read Haddish her Miranda rights. An officer mentioned smelling weed and said they needed “to address something.” The court determined that a reasonable person would offer an explanation at that point. That made the warning necessary.

Prosecutors can still present evidence from two other field sobriety tests. So Haddish’s victory remains incomplete.

Haddish’s attorneys, Marissa Goldberg and Drew Findling, want a judge to throw out the four-year-old misdemeanor case entirely. They argue the legal limbo violates her right to a speedy trial. They also say the delay has negatively impacted her career.

No one was injured or killed in the incident. Her lawyers say it is time to put this case to rest.
