Lil Durk is fighting to keep evidence out of his upcoming trial.

The rapper’s legal team filed a motion to exclude a 2021 text message from the record.

The trial is set to begin on August 20 in Los Angeles. Durk’s attorneys argue the text message has been in the custody of the Georgia Bureau of Investigation since July 2021. They claim Durk’s phone was “unlawfully seized” during a home invasion investigation.

In their filing, Durk’s legal team wrote:

“There is no good reason that the government should have waited until one month before trial to seek a warrant for evidence that has been in law enforcement’s custody since 2021.”

The move comes after Durk scored a significant win. Prosecutors attempted to add Chicago and Atlanta-based allegations to the case at the last minute. The judge scolded them and removed the allegations.

Durk’s attorneys, including Drew Findling and Brian Steel, continue to challenge the prosecution’s tactics.

The judge has not yet ruled on the latest request. The trial remains scheduled for August 20.
