The embattled mogul’s lawyers filed the request for a retrial or an acquittal after he was found guilty of two counts of transportation for engaging in prostitution, flying girlfriends and male sex workers for sexual encounters that were known as ‘freak offs’.
He was also cleared of more serious charges, such as racketeering conspiracy and sex trafficking.
Prosecutors have now responded to the request for the conviction to be thrown out or for a retrial, as it was mentioned in a court document that there was “ample evidence” presented during the trial.
The document also read:
“[Combs] masterminded every aspect of freak offs, he transported escorts across state lines to engage in freak offs for pay. He directed the sexual activity of escorts… for his own sexual gratification. And he personally engaged in sexual activity during freak offs.”
The lawyers have said that to their knowledge, he is “the only person” who has ever been convicted of these charges for what he was accused of in court. The defence team also mentioned:
“The men chose to travel and engage in the activity voluntarily, the verdict confirms the women were not vulnerable or exploited or trafficked or sexually assaulted during the freak offs or hotel nights.”
The prosecutors responded:
“Evidence of the defendant’s guilt on the Mann Act counts was overwhelming”.
The 55-year-old is due to be sentenced in October; each charge could potentially result in a jail sentence of 10 years. This would result in him facing a mandatory 15 years and up to life in prison, if he had been convicted of the charges of racketeering conspiracy and sex trafficking, of which he was exonerated.
